AGENCE JCN INC / IMPRIMETESPLANS.COM (hereinafter referred to as ITP)

GENERAL CONDITIONS AND TERMS OF OPERATION

The following terms and conditions apply to all orders placed with WWW.IMPRIMETESPLANS.COM as well as all companies and sub-companies belonging to the 9387-2935 Quebec Inc. group, including but not limited to AGENCE JCN, IMPRIMERIE JCN, LETTRAGE DRG, LETTRAGE RG, IMPRIMERIE LEGROS, NUPRINT MEDIAS, NUPRINT.CA, IMPRIMETESPLANS.COM, DRAPEAUPRO.CA.

1. QUOTE

1.1 – For all quote requests, you must send a request by email to info@imprimetesplans.com
The response time varies from 1 to 2 business days. The prices indicated in our quotes are based on the cost of paper and may change without notice after 30 days, from the date of creation of the quote.

1.2 – Quotes are based on regular hourly wage rates

1.3 Quotes are normally based on continuous and uninterrupted delivery of the entire order. However, in the event that an order is filled over an extended period of time, either as a result of delays attributable to the customer or because of the nature of the work, the customer agrees that the printer may, at its option, increase the price in proportion to any increase in wages and/or cost of materials.

2. ORDER

2.1  For any order, you must place on our website (www.imprimetesplans.com)

If you prefer to have one of our employees complete the order form for you, you will first have to fill out, sign and return to us by fax or by mail the Pre-Authorized Payment (PAP) form which also contains our terms and conditions of operation. A fee may apply for each order produced by one of our representatives.

Your order will not be printed if we do not have your completed order form.

Please note that the person completing a purchase order for you is considered your representative in this transaction and is deemed to have had authorization from you to complete this form. Therefore, your responsibility extends to any errors made by said person.

2.2 – Deadlines:

All orders for plans received before 1:00 PM are printed and shipped within 1 business day.

2.3 – We reserve the right to refuse orders if we are unable to print them. The quantities ordered may vary by +/- 2% at the time of delivery, without any change in the billing.

2.4 – Cancellation of an order :

A minimum penalty of $50.00 or 15% of the order (whichever is greater) will be charged for cancellations made after the cut-off time. No cancellations will be accepted if the material is already on press or if the plates are already out. Once paid, this amount may be used as a credit on a future order within thirty (30) days. Charges for proofs, film and plates, and any other materials required for production (e.g., cutting dies, special boxes, special paper, etc.) will be charged if these have been produced and/or purchased. Once printed or delivered, no order can be returned or credited.

However, a cancellation or modification of an order could not be respected, if ever the production of the work which is done in an automatic way by an imposition software, was already committed.

2.5  Replacement of files :

For any order placed in production and for which the customer asks us to replace files, if the material is not yet on press or if the plates have not been released and if it is possible, a fee will be charged to the customer.

3. ERRORS AND OMISSIONS

3.1 – Submissions and invoices are subject to correction. In the event of errors or omissions, even if they have passed the acknowledgement stage, ITP reserves the right to make any necessary changes to a submission or invoice, even if the latter has already been paid.

3.2  ITP is not responsible for errors if the work is printed in accordance with the client's proof. Only the details written in the quotation or the description of a product will be those used to produce the order. No indication sent by email or written in comments will be considered as a commitment to respect from ITP. Only the description in the quote will be used.

ITP will not assume any financial responsibility for errors for which it is responsible or for damages resulting from such errors; ITP will only replace the order to meet the original specifications.

3.3 – Claims for defects, damages or deficiencies must be made by the customer in writing within fifteen (15) days after delivery. Failure to submit such a claim, in writing and within the specified time period, constitutes irrevocable acceptance and acknowledgement that the work is in full compliance with the conditions and specifications. ITP's liability shall be limited to the specified selling price of any defective goods and shall in no event include special or consequential damages, including lost profits.

3.4 – For all plans printed on synthetic media for long-term use, the product warranty is limited to manufacturing defects and/or broken or defective product at the time of delivery of the product only.
Upon receipt of the goods, if the customer does not file a claim for a valid breakage or problem with a supporting photo BEFORE using it, no credit or refund will be issued by ITP.


ITP cannot be held responsible for the use of the product by the customer who could, among other things, place his product outside during high winds or bad weather and which could cause damage to the product or simply be a victim of vandalism if left outside without supervision.


No claim will be accepted by ITP for any breakage or defect with the product once the customer has used it.

4. COMPUTER GRAPHICS, COLORS AND OTHER

4.1 – ITP does not prepare any proofs for all drawing orders. Screen proofs are not used for color approval, but only for dimensions, texts and logos and/or images.
The time frame in which the plans are produced does not allow ITP to wait for a client's approval to be returned.

4.2 – ITP is not responsible for computer graphics errors on layouts that are approved by the client and on any layouts that come from your own graphic designer. This includes problems with pixelation (sawtooth) on layouts, transparency, overprint, choice of CMYK or PMS color mixes, spelling, etc.

CAUTION: We suggest that you use the OVERPINT PREVIEW option of your computer graphics software before submitting your document in order to see the final result of the work and to prevent problems due to a bad overlay of your images/text.

If you provide a vector EPS file, it will be preserved, but if you provide Photoshop files, it will be normal that your fonts, especially the very small ones, will be less beautiful when printed.

4.3 – The colors can vary at the time of printing, which is normal in CMYK process. Therefore, the accuracy and uniformity of colors cannot be guaranteed unless the customer has taken an EPSON PROOF before the order. For any digital proof or screen PDF, ITP will not be responsible for the final result.

4.4 – ITP does not undertake in any way to complete the job before the electronic files have been checked and accepted. ITP will not be responsible for any problems with the files, if any.

4.5 – Due to differences in equipment, paper, inks and other conditions between the color proof and the print room production operations, a reasonable variation in color between the color proofs and the printed work constitutes an acceptable delivery.

4.6 – Charges for modification of non-conforming files:

Conversion of an RGB file to CMYK: $20.00 + taxes
Adjustment of the format of a file: $20.00 + taxes
Adding bleed to a file: $20.00 + taxes
Any other modification will be charged at $70 per hour for a minimum of one hour.

We will still take the time to advise you when your files do not meet the technical specifications. If time permits, it will be possible for you to send us a new visual to avoid the cost of making adjustments.

4.7 – CAUTION
Please be aware that computer screens work in RGB mode and project light, unlike a CMYK print, whose pigments reflect a light spectrum that allows you to see the colors. Therefore, even if your monitor is calibrated, it is impossible to guarantee that the colors on the screen will be exactly the same as those that will come out in the print shop. Please do not rely on your home printer either.
No matter what the advertisement says or how much you pay, no home printer can produce the same results as the ones we use.

4.8 – For any order of printed plans from a scan of a plan provided by a customer who does not have these files, the quality of the print will depend largely on the condition of the plan that the customer provides us; if the paper of the plan to be scanned is all wrinkled, the printed result will not be optimal and ITP is not responsible for the final result.

4.9 – To be sure that your assemblies will be in conformity, we recommend that you read the technical specifications section.

4.10 – Electronic file: The customer is responsible for keeping a copy of his original file. Impression ITP is not responsible for any accidental damage that could occur to the documents provided by the customer.

4.11 – Computer graphics service: The company offers a computer graphics service. A minimum fee of thirty dollars ($30) is applicable for any graphic design or correction if necessary. Then, a rate of 70$/hour applies. If the work must be done in a shorter time frame, during a vacation period, in the evening or on weekends, the hourly rate can be doubled at the discretion of the printing company.

The sending of final files, one week after approval, carries a charge of ten dollars ($10) per file with a minimum charge of thirty dollars ($30), for archival research, file compression, emailing and/or burning to CD or USB key.

No files, sources or working documents used to produce the final file or product will be sent to you, as they are the exclusive property of the printing company. Only the final files will be sent to you.

5. FINISHING:

5.1 – ITP offers the following finishing service: all plans are head-bound and rolled with banding and/or inserted in a cardboard tube OR a plastic bag, depending on your delivery method. No other finishing services are available.

6. PAYMENT AND CREDIT

6.1 – Types of payment : VISA and MASTERCARD are accepted through our website. All orders are payable in full on order, unless you have an account with ITP.

6.2 – No delivery will leave ITP's offices until the invoice is paid in full.

6.3 – Customers with a thirty (30) day account with ITP may pay by check. On some orders, a deposit may be required from ITP before production.

6.4 – A $20.00 fee is applicable for all NSF checks.

6.5 – For all new customers, the total amount of the invoice is required before starting the production.

6.6 – Interest at the nominal rate of 26.8% (2% per month compounded monthly) applies to any amount that is not paid within thirty (30) days.

6.7 – In the event that ITP delivers a partially or completely defective product to the customer, due to problems not related to the latter, ITP undertakes to reprint the material, provided that the customer returns the defective product to ITP, in full quantity. In the event that a partial quantity of the material is deemed unacceptable by ITP, only that partial quantity will be reprinted and not the entire original order.

6.8 – No refund will be made for any credit granted to the customer. Thus, only a store credit, applicable on the next order, will be granted. To obtain a credit on an order with a problem or a manufacturing defect during delivery, this problem must absolutely be reported in writing (email or mail) within 30 days of the delivery date. The printing products coming with components such as retractable banners, banners, banners and coroplast with eyelets and others are guaranteed for a maximum period of 30 days from the date of delivery.

6.9 – ATTENTION : In the case of a cancellation or a modification of an order before its production, we will not make any refund. Only a store credit, in addition to the fees listed in point 2.4 according to the terms indicated, may apply. Please be careful when making your choice of product on the site and make sure you put the right product in your cart.

7. PRICES AND DELIVERY RATES

Product prices and delivery charges are displayed in Canadian currency. They are subject to change without notice.

8. PROMOTION

ITP Inc. reserves the right to refuse the application of any promotion at any time. Promotions are non-cashable and non-exchangeable and may be modified or cancelled without notice. A promotion already applied to an invoice may be revoked at any time at ITP's discretion.

9. INDEMNIFICATION

The Client indemnifies and holds ITP harmless from and against any and all losses, costs, expenses and damages arising out of any claim, demand, action or suit which may be brought against ITP on the grounds that the said print violates the copyright or property right of any person, or contains anything defamatory or scandalous, or violates any person's right to privacy or any other aspect or element of their personal rights, except to the extent that ITP contributed to the matter. The Client agrees to promptly defend and continue to defend ITP against all such claims, demands, actions or suits that may be instituted against it to ITP's full and complete exoneration, provided that ITP promptly informs the Client thereof, giving it reasonable time as may be required, depending on the exigencies of the situation, to diligently undertake and continue the said defense.

10. WAIVER

10.1 – Any waiver of these terms and conditions must be supported by a written confirmation, signed by an authorized representative of www.imprimetesplans.com. No oral agreement, change or modification of these terms and conditions shall be binding upon the Seller unless such written confirmation is provided.
